Eli Lilly is taking a stronger legal and regulatory stance against the growing black market for retatrutide, filing six new lawsuits against U.S. businesses accused of selling unapproved versions of the experimental medicine.
The move comes as demand for next-generation obesity treatments continues to rise, while retatrutide itself remains under clinical development and has not been approved for human use by any regulatory agency.
Six New Lawsuits Target Retatrutide Sellers
The lawsuits target businesses that Lilly says are involved in marketing or selling products represented as retatrutide for human use.
The defendants include:
- Aesthetic Envy Cosmetic Centers LLC, doing business as Aesthetic Envy
- Astra LLC, doing business as Astra Peptides
- Legendary Peptides LLC
- Striker Pharmacy LLC
- Texas Peptides Inc.
- Lone Star Peptide Co.
The cases were filed in federal courts across California and Texas. Lilly alleges that some sellers use “research-use only” language while marketing products in ways that indicate they are intended for consumers.
Retatrutide is an investigational triple agonist targeting GLP-1, GIP and glucagon receptors and is being studied in Phase 3 trials for obesity, type 2 diabetes and related conditions.
Its clinical potential has generated significant interest, creating an environment where consumers are increasingly encountering products claiming to contain retatrutide before the medicine has completed the regulatory process.
According to Lilly, the company has reported more than 14,000 websites, advertisements, social media posts and product listings marketing retatrutide unlawfully across more than 100 countries.
Lilly has also referred more than 200 individuals and entities to regulators, law enforcement agencies and professional licensing authorities as part of its broader enforcement effort.
The company is now asking online platforms, e-commerce companies, payment processors, credit-card networks and shipping and logistics providers to take action against businesses involved in the alleged illegal trade.
FDA Raises Concerns Over Unapproved Retatrutide
The U.S. Food and Drug Administration has separately warned about unapproved GLP-1 products and specifically stated that retatrutide cannot be used in compounding under federal law.
The agency has also warned that products marketed as “research use only” but actually intended for human consumption may present risks because their quality, safety and effectiveness cannot be verified.
The legal action highlights a broader issue facing the pharmaceutical industry: highly anticipated medicines can develop enormous consumer demand well before regulatory approval.
For Lilly, controlling unauthorized sales is not only an intellectual-property issue but also a patient-safety concern, particularly when consumers may not know what is actually contained in products purchased through unregulated channels.
The company is therefore calling for coordinated action from regulators, customs authorities, law enforcement agencies, digital platforms and healthcare providers to disrupt the supply chain supporting the black market.
As retatrutide moves through its late-stage development program, the battle over who can legally manufacture, market and distribute the drug is likely to become increasingly important.
For the pharmaceutical industry, Lilly’s latest lawsuits signal that the race around next-generation obesity medicines is no longer limited to clinical trials and regulatory approval, it is also becoming a fight over patient safety, digital commerce and control of the emerging treatment market.
